Important Information

  • VEHICLE ENTRY GATE:   OPENS 5:00am CLOSES AT 09:30pm DAILY
  • We reserve the right to extend the closing time of the vehicle entry gate to accommodate changes in flight schedules.
  • While the car park is locked overnight, if you need to collect your vehicle outside operating hours, call 0419 167 741 – a $200 call out fee applies.
  • Parking charges continue to accrue until the vehicle exits the car park.
  • This car park is monitored by CCTV and licence plate recognition cameras.

Conditions of Entry

This car park is owned and operated by Griffith City Council (‘us’, ‘we’, ‘our’ and ‘the Council’). By entering or remaining in this car park you agree to be bound by these conditions. If you do not accept these conditions, you must immediately proceed to the nearest exit and leave the car park.

Use of the car park

  1. You enter and use the car park at your own risk. We do not provide custody, care or security for vehicles or their contents.
  2. You must comply with all traffic, parking and other signs, and all directions and instructions issued by the Council or its authorised representatives. You must drive carefully and responsibly.  In particular you must:
    1. not cause any obstruction to other vehicles, driveways, bays, gates or pedestrian routes;
    2. park wholly within a single marked bay;
    3. not park anywhere that we designate as a no parking or reserved area unless you are authorised by us to park in those areas;
    4. not park in designated time restricted bays for longer than the signposted time;
    5. not use parking bays set aside for mobility impaired and/or disabled persons unless you are lawfully entitled to use these bays and you display clearly on the vehicle a current permit; and
    6. gain access to or remove a vehicle only during the opening hours we display in the car park.
  3. You must secure your vehicle when you leave it. Do not leave any personal property or valuables within the vehicle. While the Council takes care in providing the parking facilities, we accept no liability or responsibility for:
    1. any damage to, or loss or theft of a vehicle (or its contents) entering or parking in this car park; and
    2. any personal injury or death resulting from the use of this car park.
  4. Under the Australian Consumer Law, you have certain rights which cannot be excluded, including guarantees that services will be provided with due care and skill. Nothing in these conditions excludes, restricts or modifies or have the effect of excluding, restricting or modifying any condition, warranty, guarantee, right or remedy implied by law, including the Australian Consumer Law, and which by law cannot be excluded, restricted or modified.
  5. To the maximum extent permitted by law, the Council excludes liability for loss of or damage to vehicles, vehicle contents and other personal property whilst in the car park howsoever arising (except to the extent the liability is caused or contributed to by our negligence or breach of these conditions by us).
  6. If despite the above disclaimer we are nevertheless liable to you, then (to the maximum extent permitted by law):
    1. if our liability arises under the Australian Consumer Law – our liability for breach of a guarantee is limited to supplying the services to you again, or the payment of the cost of having those services supplied again;
    2. for all other cases – our liability is limited to the fees actually paid by you to us.
  7. You are entering a road related area as defined by the Road Rules 2014 and Road Transport Act 2013. The car park is patrolled. Any penalty notice issued for a parking offence is separate from, and in addition to, the fees and charges payable under these conditions.

Fees

  1. If you bring a vehicle into this car park, you must pay the parking fee and any other amounts payable under these conditions.
  2. The fees payable are those displayed at the entry to the car park at the time you enter. All fees include GST. Changes to fees apply only to entries occurring after the change is displayed.
  3. No fee is payable if your vehicle exits the car park in the free period. However, if your vehicle remains in the car park after the free period ends, fees are payable for the whole period from the end of the first hour after entry until exit. Part hours are charged as full hours.
  4. On the first day, fees accrue hourly until the daily rate is reached at which point fees are capped for that 24 hour period. For each day thereafter, the daily rate is charged for each 24 hour period (or part thereof) that the vehicle is within the car park until the weekly rate is reached at which point fees are capped for that week. For each day thereafter, the daily rate is charged for each 24 hour period (or part thereof) that the vehicle is within the car park until the weekly rate is reached at which point fees are capped for that next week.
  5. If the licence plate recognition system is unable to record your vehicle’s entry due to the plate being deliberately obscured, the daily rate is, unless you provide us with evidence of your actual time of entry.
  6. If you need to collect your vehicle outside of vehicle entry gate opening hours a $200 (inc GST) call out fee applies in addition to any parking fees which have accrued.
  7. We may prevent the exit of a vehicle from this car park until all fees are paid in full.

Your liability

  1. You must not damage, vandalise, tamper with or interfere with any Car Park Infrastructure. If you do, you are liable to Council for its reasonable costs of repairing, replacing or reinstating that property, together with our reasonable costs of investigation and recovery.
  2. “Car Park Infrastructure” includes all boom gates, access control and licence plate recognition equipment, payment terminals and systems, CCTV equipment, lighting, barriers, line marking, signage and other property of Council in or serving the car park.
  3. You indemnify the Council against any cost, expense, liability, loss or damage the Council may suffer arising out of your negligence or your breach of these conditions, except to the extent that any liability is caused or contributed to by our negligence.

Our rights in respect of your vehicle

  1. We may deny you access to the car park or your vehicle at any time if required by law or where it is reasonably necessary for the safe operation of the car park (including for maintenance, emergencies, and in connection with aviation security). We will give reasonable notice where it is practical to do so.
  2. We may also:
    1. clamp or immobilise your vehicle if you have breached these conditions;
    2. enter, move or tow away your vehicle for operational, safety or security reasons, or to respond to an emergency, or where you have breached these conditions, or where you have abandoned the vehicle.
  3. In the event that a vehicle is left on our premises for a continuous period in excess of 2 months then we may move the vehicle by towing or otherwise at your expense.
  4. Where we have clamped, immobilised, moved or towed your vehicle due to your breach of these conditions, you are liable for the costs incurred by us in doing so.
  5. You agree that we have no liability to you for any loss or damage caused by clamping, entering the vehicle or moving it.

Ticketless parking services and CCTV

  1. When you use our car park, we capture your vehicle registration plate, vehicle images, entry and exit times through recognition cameras and CCTV footage for the purposes of providing ticketless parking services, enforcement and security purposes. By entering the car park you consent to us collecting and using this information.
  2. CCTV footage may be used by the Council or a contracted car park operator, and provided to law enforcement agencies, insurers or legal representatives for security, law enforcement, damage investigations and recovery of losses.

Miscellaneous

  1. If you wish to dispute any charge levied against you under these conditions, please notify us by email to admin@griffith.nsw.gov.au with details of the dispute. We will assess your dispute notice and will contact you with our determination.
  2. If any of these conditions is illegal or unenforceable, the offending part is disregarded and does not affect the remaining terms.
  3. A reference to “You” and “Your” means the driver of the vehicle. You are taken to have been authorised by the registered operator of the vehicle to use the vehicle in the car park.
  4. Nothing in these conditions limits any power or function of Council under the Local Government Act 1993 (NSW), the Roads Act 1993 (NSW), the Road Transport Act 2013 (NSW), the Road Rules 2014 (NSW) or the Public Spaces (Unattended Property) Act 2021 (NSW).

BY ENTERING OR REMAINING IN THIS CAR PARK, YOU AGREE TO BE BOUND BY THESE CONDITIONS OF ENTRY.
